BioNear was betrayed by Rester during the final days after Mello's death. He leaked crucial information to Light, leading to Near's capture. Since Kira's victory the world has develloped a sort of fundamentalist religious furor, which Near doesn't know much about. He's living out his days in a prison along with hundreds of other anti-Kira activists, mainly artists and news anchors, that sort of thing.
Light pulls him out once a year for a day. There's dinner, wine, Near is put in formal clothes. Gloating happens, they discuss, he's thrown back in.
